Privacy policy

The protection of your personal data in all processing operations (e.g. collection, processing and transmission) is an important concern for us. Your data will be protected in accordance with the legal provisions.

The data collected are subject to the General Data Protection Regulation (DSGVO / GDPR) and the German Federal Data Protection Act (BDSG) as well as the German Telemedia Act (TMG). In addition comes, in its scope, the special protection of the German Federal Lawyers Act (BRAO) and the German Professional Code for Lawyers (BORA). We provide this extensive protection through technical and organisational measures, including TLS encryption (improved protocol compared to SSL).

The following statement provides you with an overview of what data is collected during your visit to the KSP website, when you contact KSP, or otherwise by KSP, how this data is used and passed on, what security measures we take to protect your data and how you can obtain information about the information given to us.

This privacy policy applies to the entire website and the data processed by KSP, but not to pages of other providers to which the website links.

2. Collection and storage of personal data as well as the nature and purpose of their use

a) Visiting our website; web hosting

When you visit our website, the browser used on your terminal device automatically sends information to the server of our website. The following information is temporarily stored in a so-called log file:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the accessed file,
  • Internet page from which the access is made (referrer URL),
  • request method,
  • browser used and, if applicable, the operating system of your computer.

The aforementioned data is processed for the following purposes:

  • Ensuring a smooth connection setup of the website,
  • Ensuring a comfortable use of our website,
  • evaluation of system security and stability, and
  • if necessary, for further administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 f) DSGVO. Our legitimate interest results from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies on our website. For further details, please refer to No. 4 of this privacy policy.

For the hosting of our website, we use services of Telekom Deutschland GmbH, Landgrabenweg 151, 53227 Bonn, Germany, as a data processor. This is done in accordance with Art. 6 para. 1 f) DSGVO based on our legitimate economic interest to provide our offer on this website. A corresponding data processing agreement has been concluded.

 

b) Contacting us as an applicant or interested party

If you are interested in a position advertised by us or would like to send us an unsolicited application, you can send us your application documents via the corresponding online application form or by e-mail to karriere@ksp.de.

The storage and processing of this data and other data that you provide to us as part of the application process is used to decide whether to establish an employment relationship. If an employment relationship is not established and the data is not further required for special reasons - for example, in connection with legal claims or on the basis of consent granted by you - the data will be deleted after final completion of the application process. The legal basis for data processing results from Art. 6 (1) f) DSGVO and Section 26 BDSG or - insofar as you should provide us with special types of personal data - on Art. 9 (2) a) or b) DSGVO.

If your application procedure was carried out with the involvement of a recruiter, we may pass on information about the course of the procedure to the recruiter. Your data will not be passed on to other third parties as part of the application process.

We use and store the personal data you send us to answer your questions and messages.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) a) DSGVO on the basis of your voluntarily given consent and due to our legitimate interest in answering your inquiry (Art. 6 (1) f) DSGVO).

As a rule, we store your personal data for as long as necessary for the specific processing purpose. However, we may be obliged to store some personal data for longer, for example if legal obligations require a longer storage period, or if it is needed due to (potential) legal disputes.

You are free to decide to what extent you use our homepage, the application form and the contact forms and enter and transmit your data for this purpose or otherwise contact us and provide us with personal data, for example as part of the application process.

 

c) Use of our contact forms, our service portal and the chat function; other communication with KSP

(1) For questions of any kind, we offer you the opportunity to contact us via a form provided on the website or by other means (mail, e-mail, telephone etc.).

For all data that you transmit to KSP in this process, the information listed below under (6) applies.

(2) If you have questions or messages regarding a specific claim matter, our service portal is also available to you (with or without a personal account).

Personal account: Provided you have received an appropriate access code from us, you have the option of creating an account protected by your personal password in the personal area of our service portal. If you have successfully opened an account using the relevant access code and after selecting your password and confirming it via the relevant e-mail activation link, claim-related data on the relevant file will be transferred securely to the service portal so that you can view it and contact us. You can request deletion of the account at any time (e.g., by sending an e-mail to datenschutz@ksp.de or by any other means of contact); otherwise, the account will be deleted after a period of time or depending on the file history. Note: You can decide yourself and voluntarily whether you want to use the service portal and whether you want to open the personal area of the service portal for this purpose or not. Without activating the personal account by entering the access code as well as e-mail address and password, no claim-related data will be transferred to the service portal on our part.

(4) You also have the option of communicating with KSP at any time by e-mail, by mail or by telephone. You will find the corresponding contact options in our imprint and on every cover letter you receive from us.

(5) In order to answer your inquiries and messages, it is necessary that you provide us with the personal data requested in the respective form, as this is the only way we can contact you or - when using the service portal and the chat function - verify your identity and thus ensure that we do not disclose any information to unauthorized persons.

We use and store the personal data you provide to us for the purpose of contacting you or answering your questions and messages.

Data processing for the purpose of contacting us is based on our legitimate interest in answering your inquiry (Art. 6 (1) f) DSGVO).

If the information you provide relates to a legal matter we are handling, we will store the information in the corresponding lawyer's file; data processing is then subject to the data protection requirements applicable to our files. In this case, the corresponding data processing is carried out for the assertion, exercise and defense of legal claims of our clients and thus serves their and our legitimate interests in legal prosecution. The legal basis is Art. 6 (1) f) DSGVO and, as far as the enforcement of contractual claims is concerned, Art. 6 (1) b) DSGVO. If special categories of personal data are processed in connection with the assertion, exercise or defense of legal claims, this is done on the basis of Art. 9 (2) f) DSGVO. Pursuant to Section 50 BRAO, we are obliged to keep records and to provide our clients with information and accountability for our activities. According to § 50 BRAO, this obligation also exists beyond the end of the respective matter (6 years from the end of the year in which the assignment ends). In this respect, the processing and storage also serves the fulfillment of a legal obligation (Art. 6 (1) c) DSGVO.

The storage period is measured by the necessity of the data for the stated processing purposes or retention obligations. This means that we process the data during the ongoing processing of the matter; in addition, the data is stored in the respective file until the expiry of the statutory retention obligation for attorneys pursuant to Section 50 BRAO (6 years after the end of the calendar year in which the assignment was terminated). The recipients of the data processed by us in the course of a legal matter are, in particular, our clients, as well as courts, bailiffs and, if applicable, other parties involved in the judicial process; lawyers, credit agencies and address service providers (including Regis24 GmbH, Alte Rhinstraße 16, 12681 Berlin, see www.regis24.de/informationen; CRIF GmbH, Leopoldstraße 244, 80807 Munich, www.crif.de/datenschutz); order processors, residents' registration offices, third-party debtors.

It is up to you to decide to what extent you use our homepage, the chat function and the service portal and enter your data for this purpose or otherwise contact us and provide personal data. However, we need some data to be able to identify you. If you do not provide this data, we may not be able to consider your request or correspond with you on the matter.

 

d) Payment options

Insofar as we offer you the possibility on our KSP service portal to initiate online payments on outstanding claims, the following applies:

The data you enter in the payment mask will be transferred to the selected payment service provider when you click on the corresponding link. The payment service provider processes this data and, if necessary, collects further data from you in order to carry out the payment.

The data processing by the payment service provider takes place under its own data protection responsibility. You can obtain more information about this from the respective payment provider. We receive a notification from the payment provider about the execution of the payment, which we then process for further processing of the claim.

Refunds: In the event of a refund / reimbursement, this will generally be made by the same means by which we received your payment.

 

e) Surveys

Where applicable, we may invite you to participate in an online survey to further improve our service. Participation in the survey is voluntary. The data is collected anonymously and does not allow any conclusions to be drawn about your person, unless you provide us with personal data of your own accord in a free text field. We do not query such data.

We use the online survey tool "Lamapoll" to create the surveys. This is a product of Lamano GmbH & Co. KG, Prenzlauer Allee 36G, 10405 Berlin (https://www.lamapoll.de/).

 

f) Newsletter

We offer informative newsletters on current topics to which you can subscribe.

For this purpose, we collect your e-mail address to which we send the newsletter and, if applicable, further information voluntarily provided by you during registration. For the dispatch and administration of the newsletter, we use the services of a processor with whom we have concluded a corresponding order processing agreement. The legal basis for the processing of your data is your consent (Article 6 para. 1 p. 1 a) DSGVO): With your active, voluntary declaration in the proper double opt-in procedure, which can be revoked at any time for the future, you agree that we process your data with our newsletter service provider for sending and organizing our newsletter. After registration, you will receive an e-mail in which you will be asked once again to confirm your registration. This confirmation is necessary so that no one can register with other e-mail addresses. The newsletter registration is logged in order to be able to prove the registration process according to the legal requirements. You can unsubscribe from the newsletter distribution list at any time by clicking on the corresponding unsubscribe link in the newsletter, or alternatively send us your revocation statement to our contact details provided in the imprint or by e-mail to datenschutz@ksp.de. With your declaration of revocation, we will remove your e-mail address from our newsletter distribution list and delete it, unless we are entitled or obligated to further storage in individual cases.

 

3. Disclosure of data
Your personal data will only be transmitted to third parties if the legal prerequisites exist. This is especially the case when

  • You have given your explicit consent pursuant to Art. 6 (1) 1  a) DSGVO / GDPR (this consent can be withdrawn at any time with effect for the future),

  • the disclosure is required pursuant to Art. 6 (1) 1 f) DSGVO / GDPR for the protection of our or a third party’s legitimate interests and there is no reason to believe that you have a have a predominantly legitimate interest in not disclosing your data, (this applies specifically in the case of assertion, exercise or defense of legal claims, in this case also Art. 9 (2) lit. f DSGVO / GDPR applies); see also the declaration on data recipients according to the above section. 2; the or

  • this is legally permissible and pursuant to Art. 6 (1) 1 b) DSGVO is required for the settlement of contractual relationships with you.

If data is to be passed on to a processor on behalf, these are bound by the above-mentioned and other statutory provisions and are bound to data secrecy.


4. Cookies and web services

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device, do not contain viruses, Trojans or other malicious software.

In the cookie information is stored, each resulting in connection with the specific device used. However, this does not mean that we are immediately aware of your identity.

a) Technical cookies

On the one hand, the use of cookies serves to make the use of our service more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages on our website. These are automatically deleted after leaving our page.

In addition, to improve usability, we also use temporary cookies that are stored on your device for a specified period of time. If you visit our site again to take advantage of our services, it will automatically recognize that you have already been with us and what inputs and settings you have made, so you do not have to re-enter them.

The data processed by cookies are for the purposes mentioned in order to preserve our legitimate interests as well as of third parties according to Art. 6 (1) 1 f) DSGVO / GDPR.

Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or always a hint appears before a new cookie is created. However, disabling cookies completely may mean that you cannot use all the features of our website.

 

b) Matomo

We use the open source software Matomo to create website statistics. In this context, if you have given us your consent in the Consent Management Tool, cookies (storage period 1 year) are set on your end device and access data on the use of and interactions with our website are recorded and evaluated.

The information obtained about website usage is transmitted exclusively to our servers and summarized in pseudonymous usage profiles. The collected data is not passed on to third parties. The IP addresses are anonymized (IP masking) so that they cannot be assigned to individual users.

The processing of personal data is based on your consent in accordance with Art. 6 para. 1 p. 1 a) DSGVO, § 25 para. 1 TTDSG.

a) General Information

The following applies to all links on our web pages to web pages and services of other providers (external links): We have no influence on the contents of these pages and also not on whether these providers comply with the legal data protection regulations. You should therefore always check the data protection declarations of the other providers.

b) Google Maps

To enable you to view our location on a map, we integrate - with your consent - the map display of Google. If you agree to the use of Google Maps via the Consent Management Tool or click on the map section on this website and expressly consent to its use after taking note of the notice there, we use maps from the "Google Maps" service of the provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, in accordance with Art. 6 para. 1 p. 1 a) DSGVO.

10. Safety note

KSP has taken all necessary technical and organizational security measures to protect your personal data from loss and misuse. Your data is stored in a secure operating environment that is not accessible to the public. In accordance with this Privacy Policy, access to your information is only possible through specially authorized persons.

Our information system is a secured area. A firewall is installed to prevent access from other networks connected to the Internet. Only employees who need the information to perform a specific task will have access to personal information. Our employees are trained in security and privacy practices.

If you transmit personal data to us, this data will be encrypted using so-called Transport Layer Security technology (TLS, improved protocol compared to SSL). This means that communication between your computer and KSP's servers takes place using a recognised encryption method.

11. Updating and changing this privacy policy

This privacy policy is currently valid and is current as of April 2024.

Due to the further development of our website and services or due to changed legal or regulatory requirements, it may be necessary to change this privacy policy.
