The increasing digitalisation of economic processes makes compliance with data protection more and more demanding. Furthermore, this is an area subject to constant change resulting from new legislation, the latest court rulings and increasing overlap with compliance matters.
We provide you with legal advice on all customer-oriented processes. They include data protection issues in connection with receivables, health care, telecommunications and insurance data.
Our practice areas include:
- Structuring both internal and outsourced receivables management in accordance with data protection regulations
- Legal questions on the distinction between pure contract data processing as defined in Section 11 of the German Federal Data Protection Act (BDSG) and a functional transfer as defined in Section 28 of the BDSG, with the resulting requirements
- Dealing with particularly sensitive data, which is subject to professional confidentiality (especially Section 203 of the German Criminal Code) or telecommunications secrecy (Section 88 of the German Telecommunications Act)
- Reporting receivables data to credit scoring agencies, Section 28a of the BDSG
