Banking law is characterised by continuous legislative changes, regulatory requirements from BaFin and the EU and the evolution of financial markets. It is therefore particularly important to stay up to date with current legislation and case law. 

KSP has years of experience in banking law. Our advisory and litigation work focuses on the business relationship between the bank and the customer. We advise our clients on establishing and developing these business relationships over time, if necessary right through to the enforcement of disputed claims arising from the contract. 
Our work in banking law concentrates on the following areas:

  • Payments, particularly credit transfers, direct debits, card receivables and electronic/Internet banking and credit card business

Leasing law is also subject to change as a result of the modifications brought about by case law. KSP’s advisory work comprises full-service assistance for both parties to a leasing contract. For the lessor, this will include:

  • Drafting and review of leases and leasing terms
  • Seizure of leased property by means of preliminary measures 
  • Receivables management for lessors 
  • Clarification of disputes and enforcement of financial and other claims 

For the lessee, this will include:

  • Reviewing leases and general terms and conditions for legal validity 
  • Enforcement of warranty rights against leasing companies 
  • Defending claims from final statements and compensation claims for loss of value
